1. Acceptance of Terms

By downloading, installing, or using the Seeker Battleship application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and seekerbattleship.app ("we", "us", "our"). Your continued use of the App constitutes ongoing acceptance of these Terms as they may be updated from time to time.

2. Independent Third-Party Status

Seeker Battleship is an independent application developed and operated by seekerbattleship.app. We have no relationship of any kind with Solana Mobile Inc., Solana Labs, or any entity officially associated with the Seeker device, SKR token, or Seeker Season 1 or Season 2 programs.

3. Description of Service — Theoretical Tool Only

Seeker Battleship provides on-chain activity analysis and a speculative, theoretical airdrop tier prediction for Solana Seeker Season 2. The App analyzes publicly available blockchain data associated with your wallet to generate a composite score and a predicted tier. This service is provided purely for informational and entertainment purposes.

4. Eligibility

To use the App you must:

• Be at least 18 years of age (or the legal age of majority in your jurisdiction)
• Own a Solana Seeker device with a valid Seeker Genesis Token (SGT)
• Have a compatible Solana wallet accessible via the Seeker's Seed Vault
• Comply with all applicable laws and regulations in your jurisdiction
• Not be a resident of a jurisdiction where use of the App would be unlawful

By using the App, you represent and warrant that you meet all eligibility requirements.

5. Payments and Refunds

The App offers a limited number of free predictions per wallet. Additional predictions require payment in SKR, SOL, or USDC tokens via an on-chain Solana transaction.

• All payments are processed on the Solana blockchain and are final and irreversible once confirmed on-chain
• We do not offer refunds for completed on-chain transactions under any circumstances
• Payment amounts are set by our remote configuration and may change at any time without prior notice
• You are responsible for all network (gas) fees associated with on-chain transactions
• Payment for a prediction does not guarantee any particular score, result, tier, or airdrop outcome
• If a technical failure prevents delivery of a paid prediction, contact seekerbattleship@proton.me — we will investigate and provide a remedy at our discretion
• We are not responsible for failed transactions due to network congestion, insufficient funds, or wallet issues

6. No Financial or Investment Advice

We strongly encourage you to seek independent professional financial and legal advice before making any decisions based on information provided by this App.

7. Wallet and Security

You are solely responsible for the security of your Seeker device, Seed Vault, and associated wallet.

• We never have access to your private keys, seed phrases, or cryptographic secrets
• Never share your seed phrase with anyone — including us
• We will never ask for your private key, seed phrase, or any security credential
• You are responsible for all transactions initiated from your wallet
• We are not liable for any loss of funds due to unauthorized access to your wallet, phishing, or device compromise
• If your device is lost or stolen, contact Solana Mobile support immediately

8. Intellectual Property

The App, including its source code, design, user interface, scoring algorithms, models, and all content, is the intellectual property of seekerbattleship.app. All rights are reserved.

You may not copy, modify, distribute, sublicense, reverse-engineer, decompile, disassemble, or create derivative works from any part of the App without our prior written permission.

The "Seeker", "SKR", "Solana Mobile", and "Seed Vault" trademarks and related intellectual property belong to their respective owners. We use them for descriptive purposes only and do not claim any affiliation, endorsement, or sponsorship.

9. User Conduct and Prohibited Uses

You agree not to use the App in any way that:

• Violates any applicable law, regulation, or third-party rights
• Attempts to reverse-engineer, replicate, or circumvent the scoring algorithm
• Uses automated tools, bots, or scripts to generate fraudulent predictions or bypass payment requirements
• Misrepresents App predictions as official Solana Mobile or Seeker communications
• Resells, sublicenses, or commercializes prediction results without our written consent
• Interferes with or disrupts the App's servers, infrastructure, or backend services
• Attempts to gain unauthorized access to any part of our systems
• Creates false impressions of affiliation with official Seeker programs
• Harasses, defames, or harms other users or third parties

Violation of these provisions may result in immediate termination of your access to the App.

10. Accuracy of On-Chain Data

The App fetches data directly from the Solana blockchain via third-party RPC providers. While we strive for accuracy:

• We cannot guarantee that all on-chain data is complete, accurate, or up-to-date at the time of fetching
• RPC providers may impose rate limits, return stale data, or experience downtime
• Some historical transactions may not be retrievable due to blockchain data availability limits
• Scores calculated from incomplete data may be lower than they would be with full data access

We are not liable for inaccuracies in scores or predictions resulting from incomplete or inaccurate on-chain data.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the App will be error-free, uninterrupted, or available at all times
• That prediction scores are accurate, complete, or reflect actual Season 2 criteria
• That on-chain data fetched via RPC is accurate, complete, or current
• That the App is compatible with all devices or operating system versions
• That any defects will be corrected

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, seekerbattleship.APP AND ITS OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, or anticipated savings
• Loss of cryptocurrency, tokens, or digital assets
• Loss of expected airdrop rewards or token distributions
• Loss of data or goodwill
• Damages arising from your reliance on any App prediction or score

Our total cumulative liability to you for any and all claims arising from or related to your use of the App shall not exceed the total amount you paid to us in the 30 days immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless seekerbattleship.app and its operators, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or access to the App
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Your reliance on any App prediction, score, or tier estimate
• Any transaction you initiate through or because of the App

14. Third-Party Services

The App integrates with third-party services including Helius RPC, CoinGecko, and the Solana Mobile Wallet Adapter. We are not responsible for the availability, accuracy, or conduct of these services. Your use of such services is subject to their own terms and policies.

15. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to violation of these Terms. You may stop using the App at any time.

Upon termination, all licenses granted to you under these Terms immediately cease. Provisions that by their nature should survive termination shall do so, including Sections 3, 6, 8, 11, 12, 13, and 16.

16. Changes to Terms

We may update these Terms at any time. We will indicate the updated date at the top of this page. For material changes, we will endeavour to provide notice within the App. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

If you do not agree to updated Terms, you must stop using the App.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the competent courts of the applicable jurisdiction.

You agree to bring any claim on an individual basis and not as part of any class action or representative proceeding.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and seekerbattleship.app regarding your use of the App and supersede all prior agreements and understandings.
